PROPOSED BAYOU BEND SUBDIVISION - 3RD PETITION

At the next Planning and Zoning Meeting, Jeff Schoen will present the developer’s third iteration of their plot-plan for the Bayou Bend Subdivision on Carroll Road. Incidentally, this is a common tactic used by this attorney. Under the guise of “making it better,” he reduces the project’s scope in order to assuage those in opposition for what constitutes a poorly planned and detrimental project. Ostensibly, this affords some maneuvering room for members of the Zoning Commission and for members of the Council. Our intent is to thwart these zoning petitions to the fullest extent possible. With that resolve, we again solicit your assistance.

 Their latest strategy seeks a rezoning of 11.97 acres of the parcel from A-3 to A-4, and then, for the entire 47.43-acres, adding a PUD overlay. This constitutes two separate zoning petitions involving property that lies in a sensitive area located within the Bayou Liberty Basin.

 BLA opposes these dual rezoning requests for the following reasons:

            1) It sets an ominous precedent for future adverse rezoning and development in the Bayou Liberty Basin

            2) Drainage of excess water runoff and pollutants onto adjacent private property, directly into Bayou Liberty, and ultimately flowing into Lake Pontchartrain

            3) Increased traffic congestion for the two lanes on Carroll Road

            4) Sewerage treatment facility's existence, location, and effluent consequences

            5) Wetlands concerns, and markedly diminishing the native land’s absorption and filtering capacity

The Zoning Staff Report reiterates their concerns with increasing the zoning density for this area. Staff appropriately and accurately contends that permitting this rezoning would result in adverse effects to the surrounding area. Please emphasize to the 11 Zoning Commissioners our resolute opposition to any rezoning of this property.
